Acceptance of Terms

By using any JAM Service, you agree to comply with these Terms and any applicable instructions, policies, or additional terms presented to you in connection with a particular Service.

The continued use of the Services constitutes your acceptance of these Terms. These Terms may be updated from time to time, and your continued use of the Services following any updates will constitute your acceptance of the revised Terms.

As JAM continues to expand its range of products and services, any new Services introduced by JAM shall also be subject to these Terms unless otherwise stated.

Users must be 18 years of age or older to access and use the Services.

By using the Services, you confirm that you meet the applicable age requirement and have the legal capacity to enter into and comply with these Terms.

JAM provides users with access to digital content and services through websites, mobile applications, mobile services, and other supported platforms.

The Services may include, but are not limited to:

Digital entertainment and educational content;

Music and audio content;

Videos and other multimedia content;

Games and interactive services;

E-books and audiobooks;

Mobile applications;

Subscription-based digital services;

and other digital products and services introduced by JAM from time to time.

The specific features, content, availability, subscription method, pricing, and duration of each Service may vary depending on the product, territory, mobile network operator, and applicable subscription plan.

When accessing JAM Services through a mobile device, your mobile network operator may apply standard charges, including messaging, VAS messaging, data, download, or other applicable network charges.

Users are responsible for checking with their mobile network operator regarding:

The availability of the Services;

Applicable network or data charges;

Device compatibility;

Service restrictions; and

Any other charges that may apply.

JAM shall not be responsible for charges imposed by a mobile network operator or third-party service provider.

JAM shall also not be responsible for any failure, delay, interruption, or loss of service resulting from network transmission failures, messaging failures, telecommunications infrastructure, or other circumstances outside JAM's reasonable control.

Certain JAM Services may require a paid subscription.

Where applicable, subscription charges, subscription periods, renewal terms, and other applicable conditions will be communicated to the User before or during the subscription process.

By subscribing to a Service, the User authorizes the applicable mobile network operator, billing provider, payment provider, or other authorized service provider to process the applicable charges.

Access to a Service may continue for the applicable subscription period and may be subject to automatic renewal or recurring charges where such arrangements have been communicated to the User.

Users are responsible for reviewing the applicable subscription information before confirming a subscription.

Users are responsible for all activities carried out through their account, mobile number, device, or other credentials used to access the Services.

Users must:

Keep their account and access credentials secure;

Not share their account credentials with unauthorized persons;

Comply with all applicable laws and regulations;

Follow any instructions, codes of conduct, or notices provided by JAM;

Promptly notify the relevant service provider if they become aware of any unauthorized access or security breach; and

Use the Services only for lawful and permitted purposes.

JAM may suspend or terminate a User's access to any Service if JAM reasonably believes that the User has violated these Terms, applicable laws, or any applicable Service-specific conditions.

Users agree not to:

Use the Services for any unlawful or unauthorized purpose;Copy, reproduce, distribute, sell, resell, or commercially exploit JAM content without authorization;

Attempt to gain unauthorized access to JAM systems or Services;

Interfere with or disrupt the operation of the Services;

Circumvent or attempt to circumvent subscription, security, or access controls;

Use the Services in a manner that may harm JAM, its partners, licensors, or other users; or

Engage in any activity that violates applicable laws or regulations.

JAM reserves the right to take appropriate action where a User's activities are reasonably considered to be harmful to JAM, its users, partners, or the operation of the Services.

All content made available through the Services, including but not limited to text, software, scripts, graphics, photographs, sounds, music, videos, interactive features, digital materials, and other content (“Content”), is owned by or licensed to JAM and is protected by applicable copyright, trademark, and other intellectual property laws.

The trademarks, service marks, logos, names, and other marks displayed through the Services (“Marks”) are owned by or licensed to JAM or their respective owners.

Users may access, view, listen to, or otherwise use the Content solely for their personal, non-commercial use, subject to these Terms and the applicable subscription conditions.

Unless expressly authorized in writing by JAM, Users must not:

Reproduce or copy the Content;

Retransmit or distribute the Content;

Sell, rent, lease, or sublicense the Content;

Broadcast or publicly perform the Content;

Make the Content available to third parties;

Modify or create derivative works from the Content; or

Otherwise commercially or non-commercially exploit the Content.

Unauthorized use, reproduction, distribution, or exploitation of JAM's intellectual property may result in legal action.

The content provided through JAM Services, including movies, music videos, short videos, audio, text, software, graphics, photographs, and other digital materials, is protected by applicable copyright laws.

Unauthorized copying, reproduction, distribution, transmission, or other use of such materials is prohibited and may result in legal action.

JAM retains ownership of its trademarks, service marks, logos, brand names, and other intellectual property unless otherwise stated.

Users may not use, reproduce, modify, or display JAM trademarks or logos without JAM's prior written consent.

Unauthorized use of JAM trademarks or logos may constitute a violation of applicable copyright, trademark, and other intellectual property laws.

The Services may contain links to or integrations with third-party websites, applications, platforms, or services.

JAM does not control third-party websites or services and is not responsible for their content, availability, security, policies, or practices.

If you access a third-party website or service through a link or integration provided through the Services, you do so at your own risk. Users should review the applicable terms and policies of such third parties before using their services.

JAM understands the importance of protecting User information.

Information collected through the use of the Services may be handled in accordance with JAM's applicable Privacy Policy.

By using the Services, you acknowledge that information may be collected, processed, used, and shared as described in the applicable Privacy Policy and as permitted by applicable law.

Where required, information may be shared with service providers, business partners, mobile network operators, payment providers, technology providers, or government and regulatory authorities for purposes including providing the Services, processing subscriptions or payments, maintaining security, preventing fraud, complying with legal obligations, and improving the Services.

The Services may involve communications through electronic means, including SMS, email, mobile applications, websites, or other electronic channels.

You acknowledge and agree that communications transmitted electronically may satisfy applicable legal requirements for written communications, where permitted by law.

JAM shall not be responsible for technical failures affecting the transmission, receipt, delivery, or reading of electronic communications where such failures are outside JAM's reasonable control.

JAM will use reasonable efforts to maintain the availability of its Services. However, JAM does not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

The Services may be temporarily unavailable due to:

Maintenance;

Technical failures;

Network interruptions;

Telecommunications failures;

System upgrades;

Security incidents;

Third-party service failures; or

Circumstances beyond JAM's reasonable control.

JAM reserves the right to modify, suspend, discontinue, or restrict any Service or part of a Service where reasonably necessary.

To the maximum extent permitted by applicable law, JAM disclaims all warranties, whether express or implied, in connection with the Services and their use.

JAM does not guarantee that:

The Services will be uninterrupted;

The Services will be error-free;

All Content will always be available;

The Services will be compatible with every device or network; or

The Services will meet every User's individual requirements.

To the maximum extent permitted by applicable law, JAM, its licensors, suppliers, partners, affiliates, and third-party service providers shall not be liable to any User or third party for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages, or any other damages arising from or relating to these Terms or the use of the Services.

This includes, without limitation, damages arising from loss of data, loss of profits, loss of business, interruption of service, or inability to access or use the Services, regardless of the form of action or legal basis of the claim.

Nothing in these Terms shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

To the maximum extent permitted by applicable law, the User agrees to indemnify and hold JAM, its licensors, suppliers, partners, affiliates, employees, officers, and service providers harmless from claims, liabilities, damages, losses, costs, and expenses arising from:

The User's breach of these Terms;

The User's misuse of the Services;

The User's violation of applicable laws;

Unauthorized use of the Services through the User's account or device; or

The User's violation of the rights of JAM or any third party.

JAM may suspend or terminate a User's access to any Service where:

The User breaches these Terms;

The User violates applicable laws;

The User engages in unauthorized or fraudulent activity;

JAM reasonably believes that the User's activity may cause harm to JAM, its partners, or other Users; or

Termination or suspension is otherwise necessary for operational, security, legal, or regulatory reasons.

Upon termination, any rights granted to the User under these Terms may immediately cease.

Provisions that by their nature should continue after termination, including intellectual property, limitation of liability, indemnification, and governing law, shall continue to apply.

JAM may modify, update, or replace these Terms from time to time.

Where required by applicable law, JAM will provide notice of material changes.

Users are encouraged to review these Terms periodically. Continued use of the Services after the effective date of any updated Terms constitutes acceptance of the revised Terms.

Users must comply with all applicable laws, regulations, rules, and requirements when accessing or using the Services.

Users must also comply with the applicable terms and conditions of their mobile network operator, payment provider, application platform, or other third-party service provider used in connection with the Services.

These Terms shall be construed in accordance with and governed by the laws of Sri Lanka.

Any controversy, claim, or dispute arising out of or relating to these Terms or the relationship between the parties, whether during the existence of the relationship or afterwards, shall be subject to the jurisdiction of the High Court of Colombo, Sri Lanka, to the extent permitted by applicable law.

These Terms, together with any applicable Service-specific terms, subscription conditions, and policies referenced herein, constitute the agreement between the User and JAM concerning the use of the Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the extent permitted by law.
